Terms & Conditions

Please read the following terms and conditions of the contract between you, the purchaser and us, St Boniface Studios:

Definitions

Original A work that has been created manually bythe artist, usually one-of-a-kind.

Reproduction Print A copy or facsimile of an original work. Reproductions can be limited i.e. part of a finite series, or they can be open-edition i.e. unlimited number produced.

Limited Edition Print A limited series of impressions of a given image, usually fewer than 500, each signed and numbered by the artist.

Digital Photograph Image capture using a digital camera and then printed.

Delivery of items

We aim to dispatch within 2 working days. We use First Class Royal Mail or Parcel Force for UK delivery. If we receive a cheque we may wait for it to clear before dispatch. For other EU countries please ask us what the costs will be to your country. If Original works are to be delivered then we recommend using Postal Insurance. We do not deliver to P.O Boxes, A refund can only be claimed for returned goods if they reach us in good condition. Delivery of the Products shall be made to the address notified by the Buyer as the delivery address. The Buyer shall make all arrangements necessary to take delivery of the Products whenever they are tendered for delivery. If the Buyer fails to take delivery of the Products or fails to give St Boniface Studios adequate delivery instructions then St Boniface Studios may return the Products to the studio artist(s) with the Buyer remaining liable for all shipping and delivery costs for the Products. If on delivery the packaging for the Product is damaged then, before accepting the Product from the delivery company, the Buyer must immediately check that the Product itself is undamaged. If the Product itself appears to be damaged as a result of damage to the packaging, the Buyer must immediately report this to the delivery company official and notify St Boniface Studios accordingly within 24 hours.

Non EU customers

We recommend that you ask about postage costs before ordering. We do not ship original works outside the EU. In most cases (e.g. United States) we do not anticipate that the customers will need to pay any import duties, providing they are purchasing as private customers. Where these do arise, however, the customer is responsible for paying these fees.

Tax & Duties

If you want your purchase to be delivered outside the European Union, you will automatically be responsible for paying all applicable duties.

Applicable law

St Boniface Studios is an English Company, so every sale shall be deemed to be performed in England; English law shall govern each transaction, including (without limitation) all contractual and other relationships, which arise as a result of such sales. You and we submit to the non-exclusive jurisdiction of the English courts in relation to any disputes arising out of any sale.

Making a contract with us

When placing an order ensure that you use your correct name, address and any other requested details. We do not have access to your credit, debit or charge card details. On-Line Payments are made via PayPal or Nochex, if paying in this way you must agree to abide by the terms and conditions of those companies. If any of the information you enter becomes incorrect or is superseded, then please notify us with the corrected information. To register for St Boniface Studios services, you must legally be able to enter into contracts for goods and services that you may buy here. Where a Buyer is under 18 St Boniface Studios reserves the right to require confirmation of any order to be given by an adult who is related or otherwise connected to such Buyer.

Misuse of our site or products

St Boniface Studios reserves the right to refuse to sell to anyone who we believe may put our products to an inappropriate use, transgress our Copyrights of our products, or misrepresent themselves in terms on intended end product use.

Consumer protection

when paying On-Line PayPal and Nochex offer an extensive Buyer Protection Policy. You are free to cancel an order and claim an immediate full refund if the goods have not yet been dispatched. You may return goods and claim a refund within 14 days of receiving them (but you must arrange and pay for the return). Where the order of a commissioned product has been cancelled, the buyer remains liable for all costs incurred by the artist up to that point. Please note that Consumer protection acts will only protect genuine consumers, not people who are buying the products with the intention of selling them on, i.e. you can't bulk buy and then return to us 14 days later everything that you haven't managed to sell!

Corrections

Descriptions of goods and services included in the St Boniface Studios site are accurate to the best of our knowledge; we try to correct errors or omissions as soon as we are aware of them. However, colours and appearance of images, mounts and frames may vary very slightly from the way they appear on the screen. Also print sizes can vary slightly with each production run. If you need to know the precise dimensions of a product, please contact us. Any typographical, clerical or other error or omission in any description of the Product on the Site or in any quotation, price list, acceptance of offer, invoice or other document or information issued by St. Bonfiace Studios shall be subject to correction without any liability on the part of St. Bonfiace Studios. We reserve the right to withdraw from a sale and return your full payment to you,

Copyright

You must accept that the images shown on the St Boniface Studios website are the property of St Boniface Studios or their respective copyright owners, and are used by St Boniface Studios pursuant to express authorisation from copyright owners or their agents. You acknowledge that all copyright, trademarks and other intellectual property rights in and relating to St Boniface Studios are vested in St Boniface Studios or our partners where appropriate. You must not use, reproduce, modify or distribute our images or any part of those images in any manner, whatsoever. In the event that there is any dispute between us in relation to this issue, you agree that until the matter is resolved, an interim injunction will be an appropriate remedy. An Interim injunction is a court order, which would prevent any further use or distribution of the image that we are concerned about, until a final court hearing where the court will make a decision on all the facts. If you buy a reproduction print you have not bought rights to make further copies of that print. If we sell you an Original work we retain the right to continue to sell reproductions of that image.

Loss or injury

We are not be liable to you or any third party for any indirect or loss or damage, or for any loss of data, profit, revenue, business or management time, howsoever caused. You also agree that the liability of St Boniface Studios under this agreement (whether arising in negligence or otherwise), will not under any circumstances exceed the greater of a) £500 or b) an amount equal to the sums paid or payable by you. This does not affect your statutory rights as a consumer. You should note that our picture frames contain glass which could break and cause injury. You should satisfy yourself of the structural integrity of such frames before accepting ownership.

Consequential Loss

In the event of consequential loss, St Boniface Studios can only be responsible for the cost of your order.

Reasonable Control

St Boniface Studios shall not be liable for any failure to perform its obligations under this agreement if caused by matters beyond our reasonable control.

Changes to this Agreement

St Boniface Studios reserves the right to change the terms of this agreement from time to time, and post a new version on our website. The new version will take effect from the day of posting on the site. Price and availability information are also subject to change without notice.

Severability

In the event that any term of this agreement is held to be unenforceable or invalid by judicial decree or decision, the remainder of this agreement shall remain valid and enforceable.

Security and Privacy

Information you give us during the ordering process as well as any that we know about you by other means will not be divulged to a 3rd party without your consent. Information will be used in accordance with the Data Protection Act 1998.
